The Tembo website and platform are hosted by a professional hosting provider. The host's details can be provided on request at contact@tembo-event.com.

The host provides storage and availability of the site's content; it plays no part in defining the services offered by Tembo.

4. Intellectual Property

The "Tembo" trademark, its logo, its visual identity, as well as the structure, texts, visuals, databases and all elements making up the site and platform are protected by intellectual property law and remain the exclusive property of the publisher or its rights-holding partners.

Any reproduction, representation, modification, extraction or reuse, in whole or in part, of these elements without the prior written authorization of the publisher is prohibited and may engage the liability of its author.

Content published by organizers (event descriptions, visuals, programmes, logos) remains the property of their respective authors, who warrant ownership thereof and grant Tembo a licence strictly necessary to display the event on the platform.

5. Personal Data and Cookies

The processing of personal data carried out through the site and platform (accounts, networking profiles, messaging and video-conferencing metadata, order and payment data, newsletter) is governed by Organic Law No. 2004-63 of 27 July 2004 on the protection of personal data and is subject to the oversight of the National Authority for the Protection of Personal Data (INPDP).

Tembo never stores raw payment card data: payments are processed by a certified payment provider (Flouci, ClicToPay, Stripe and bank transfer).

The methods of collection, the purposes, retention, sharing and the exercise of your rights, as well as the use of cookies and trackers, are detailed in the privacy policy.

6. Sales and Ticketing

Tembo acts as a technical ticketing intermediary: for each event, the organizer is the seller and merchant of record, while Tembo provides the connection, the collection of payments and the delivery of tickets.

The terms of ticket sales, prices, currencies (TND, XOF, NGN), cancellation arrangements and refund conditions are set out in the general terms and conditions of sale and the refund policy.

Where a right of withdrawal applies, the attendee has a period of ten (10) working days from the confirmation of their order to exercise that right, in accordance with Tunisian regulations. For tickets granting access to an event on a fixed date or for a fixed period, the conditions and limits of withdrawal, cancellation and refund are expressly defined by the organizer in the general terms and conditions of sale and the refund policy of the relevant event, which prevail and which the attendee accepts at the time of purchase.

These documents form an integral part of the contractual relationship between the organizer, the attendee and Tembo.

7. Liability and Availability

Tembo makes every effort to ensure the accuracy and updating of the information published on the site, as well as the availability and security of the platform. However, Tembo cannot be held liable for interruptions, unavailability, errors or malfunctions beyond its control, in particular those resulting from maintenance, force majeure or the internet network.

As a technical ticketing intermediary, Tembo is not the organizer of the events and does not guarantee that they will be held, nor their content, quality or proper conduct, which are the sole responsibility of the organizer. Nor is Tembo responsible for content published by organizers or attendees, or for exchanges taking place within the framework of B2B matchmaking, messaging or video conferencing.

The user is solely responsible for the use they make of the site and platform, as well as for the accuracy of the information they provide.

8. Hypertext Links

The Tembo website and platform may contain hypertext links to third-party sites (organizers, partners, payment provider). These sites are independent of Tembo, which exercises no control over their content and disclaims any liability for their information, products or services.

The creation of links to the Tembo site is permitted provided that it does not harm the interests or image of the publisher; the latter reserves the right to request their removal at any time.

9. Governing Law

This legal notice, the Tembo website and platform are governed by Tunisian law, in particular Law No. 2000-83 of 9 August 2000 on electronic exchanges and electronic commerce, Organic Law No. 2004-63 of 27 July 2004 on the protection of personal data, and Law No. 92-117 of 7 December 1992 on consumer protection.

Failing an amicable resolution, any dispute relating to the site shall be brought before the competent courts of Tunis, subject to the applicable mandatory legal provisions.
